TERMS AND CONDITIONS FOR THE USE OF TECHNICAL SUPPORT SERVICES

  1. DEFINITIONS

Raropem RO SRL (hereinafter referred to as „Provider”) makes available to its customers, through its website raropem.ro a contact form (hereinafter referred to as the „Contact Form”), by completing which customers can request technical assistance regarding the purchase of parts.

Website raropem.ro are the property of Raropem RO SRL, with headquarters in Baia Mare, str. Depozitelor, no. 2, County, Maramures, registration number in the Trade Register J24/1/2015, CUI RO 33937911. The client is a company that conducts commercial relations with the Supplier regarding the purchase of products from the Supplier's portfolio. Within these terms and conditions, Raropem RO SRL clients will hereinafter be referred to as „Users”.”

  1. STATEMENTS

Accessing and using the Website, as well as the Contact Form, automatically implies full and unconditional acceptance of these terms and conditions. The User declares that they are aware that the Provider benefits from all rights granted by law concerning the Provider's ownership of the Website and the materials/information published on the Website.

Therefore, all copyrights for the information on the Site – texts, graphics, photographs, software, logos, etc. – are owned by the Provider or other copyright holders of the respective materials for which the Provider holds a right of use. Materials published on the Site may not be reproduced, used, or modified in any way without the prior written consent of the Provider. The User acknowledges that technical assistance will be provided remotely and only based on the information transmitted by the Users.

  • CONFIDENTIALITY

The user undertakes not to disclose any information to which they have access through the use of the Site, as well as through correspondence regarding technical assistance, directly or indirectly, except in cases where the Provider has expressly given prior consent. Users assume the obligation to maintain, during the course of commercial relations with the Provider and for an unlimited period of time after their termination, strict confidentiality of all data related to the Provider's activity or any other information to which they have had access by accessing the Site, such as, but not limited to: information, documents, technical solutions received from the Provider, etc.

The confidentiality obligations undertaken by Users through signing other documents with the Provider remain valid and continue to produce their effects. By submitting the Contact Form, the User confirms their agreement to maintain the confidentiality of the information obtained at all times, and not to disclose, make public, directly or indirectly, transfer, or use for other purposes the confidential information received. The information transmitted by the Provider during the technical assistance process may only be used by the Users to whom it is transmitted.

Therefore, any reproduction, copying, multiplication, sale, publication, or distribution by any means, including electronic means, of information received through the Site and during the technical support process is prohibited. Failure to comply with the confidentiality obligation will result in User liability and payment of damages.

  1. TECHNICAL SUPPORT SERVICES PROVISION

Technical assistance services will be provided upon request.

  1. LIMITATION OF LIABILITY

The information provided by the Provider during technical assistance is for guidance purposes only. The Provider does not guarantee that the information/solutions recommended for car repairs will meet all User requirements. The Provider will make all reasonable efforts to offer Users the best technical solutions to the problems indicated and identified by them, strictly based on the information provided by the Users.

The Provider assumes no obligation regarding the resolution of issues indicated by the User and will not be liable for situations where a solution cannot be identified for one or more of the issues indicated by the User. Thus, all information and technical solutions offered by the Provider will only have the value of recommendations and will not create any obligation on the part of the Provider. The Provider does not guarantee that the technical information provided will resolve the reported issue or that these solutions do not present any risk.

Therefore, any action or inaction taken by the User based on the information and technical solutions provided by the Provider shall solely be the User's responsibility in the event that the User or any third party suffers damage as a result of implementing the solution offered by the Provider. The Provider does not guarantee and does not undertake the obligation that:

  • technical assistance services will be provided without interruption;
  • will give you an answer within a certain timeframe;
  • The site will function without errors or interruptions;
  • the documents, files, or any other data packages contained or linked to this Site do not contain viruses (malware)

The supplier shall not be liable:

  • for any kind of direct or indirect damages, loss of profits, or any other type of damages of any nature resulting from the use or inability to use the information contained on the Site
  • for no damage whatsoever, of any nature, present or future, caused by or through the Site.
  1. CESSATION OF TECHNICAL ASSISTANCE

The provider has the option to terminate the provision of technical assistance at any time, without prior notice, without being liable for damages.

  • Data Protection

Technical support is exclusively available to customers of the Provider. Therefore, the following personal data of individuals designated by the User will be collected for the provision of technical support: name, surname, email address, phone number, username, and password, etc.

The individuals targeted are the User representatives who will access the User account. Any processing of data relating to individuals will be carried out in compliance with applicable legal provisions. The User undertakes to comply with European Regulation no. 679/2016 concerning personal data. In this regard, the User agrees to inform their own employees or other persons designated by the User about the processing of personal data: name, surname, email address, phone number, username, and password, and to obtain the relevant consent from them.

The User undertakes to inform their employees and other persons designated by the User that personal data processed by the User will be transferred to Raropem RO SRL for technical assistance. If the User fails to comply with the provisions regarding the processing of personal data, they understand and accept that they are responsible for any damages caused to the data subject and the Provider. In this situation, the Provider is entitled to refuse to provide technical assistance.
